The organization reserves the right of admission and permanence of the participants and may exclude them from the trip for the following reasons: bad behavior, poor health, attitude, damage to the environment, consumption of drugs, liquor, or beer, etc. When the participant(s) are excluded due to any of the reasons above, they are not entitled to any refund for unused services.

Once the journey has begun, any suspension, modification, or disruption of services on behalf of the passengers for any reason will not result in claims, rebates, or refunds. Weather, road, and river conditions may force the organization to change the duration, path, or activities originally planned. The company may modify and/or suspend the voyage if there are factors that may endanger the safety of participants. In these cases, there is no money reimbursed when the journey has been modified for safety concerns. If canceled once on the water (rafting or kayaking), there is no refund. 50% will be reimbursed if the trip is canceled prior to the beginning of the activity (rafting).

Underage participants should submit written permission from parents or guardians to perform activities in water.

The risks of using a raft or kayak, hiking and kayaking include, but are not limited to, the following: entering and exiting the watercraft; water that may be fast, deep, cold, and subject to rapid change; objects in and out of the that may not be obvious, such as animals, paddles, debris, trees, rocks, boulders, dams, bridges, and other hazards; the watercraft may overturn, swamp, or sink, and the occupants may become separated from the craft; feet and other parts of the body may become entrapped in or under rocks and other objects; The tour operated by Aventuras H2O S.A. involves the risk of any damage to the participants’ belongings and/or their physical or mental health, or even death; the participant assumes the risk and responsibility for any loss or damage that may occur.

Aventuras H2O S.A. is not responsible for valuables that are lost during the trip, including but not limited to cash, credit cards, watches, jewelry, glasses, passports, etc. All valuables worth more than $100 should be declared and stored on our premises. This is a free service.

Medical information: Aventuras H2O will not determine and does not accept responsibility for the participant’s physical, medical, or any other condition that determines if this participant is suitable to perform the activity. The participant must inform us if she is pregnant. The participant has to provide any specific medications that they must receive in an emergency and give medical information to the organization about his or her condition immediately after signing this waiver.

Photographs and videos taken during the trip will be used as advertising, subject to copyright laws. Based on the Law of Copyright, photos and videos taken during the tour will be able to be used for advertising the company.

Challenge by choice: According to our experience, we implement the best safety practices on our trips. If at any point you believe what we say would endanger your safety, you have the right not to do it. Your decision does not alter any other conditions of this waiver.

I agree that any dispute arising from or relating to this agreement, H2O Adventures S.A., tour brochures, or any other materials pertaining to my tour, the tour itself, or any claim for damages arising from injury or death that occurs during or in connection with my tour shall be resolved exclusively in Quepos, Puntarenas, and under Costa Rican laws.

EXEMPTION OF LIABILITY.

This agreement is entered voluntarily and after careful consideration. Its terms cannot be amended except in writing. I understand that it is binding, to the fullest extent allowed by law, upon all persons signing below, our respective heirs, executors, administrators, wards, minor children (whether they are Clients), and other family members. If any part of this agreement is found by a court or other appropriate authority to be invalid, the remainder of the agreement nevertheless shall be in full force and effect.
